§ 17-21. Election results; creation of governing board.

  • (a)

    Not later than twenty (20) days after any election for the creation of a service district, the board of county commissioners shall hold a meeting and shall canvass the vote of said election and declare the results. If a majority of the resident freeholders in the proposed district vote in favor of the formation of a service district, the board of county commissioners shall so certify to the governor and secretary of state.

    (b)

    Upon receipt of such official notice, the governor of the State of Florida shall forthwith appoint three (3) discreet citizens, who are resident freeholders in the district, to be the governing board of the service district. The governor shall issue to each commissioner thus appointed a commission declaring his appointment as a commissioner of the service district. Of the commissioners initially appointed, one (1) commissioner shall be appointed for a term of two (2) years, one (1) commissioner shall be appointed for a term of three (3) years, and one (1) commissioner shall be appointed for a term of four (4) years [;] thereafter, all appointments shall be for a term of four (4) years, or until a successor is duly appointed and qualified.
