§ 2-5. Local telephone exchange subscribers' fee imposed by companies providing 911 services.
(a)
Imposed. Pursuant to the Florida Emergency Telephone Act, as amended, (Section 365.171, Florida Statutes, 1983, as amended, herein the "Act") there is imposed a fee of up to fifty cents ($0.50) per month upon each individual telephone exchange line located in Franklin County, which said fee shall be paid by local telephone subscribers for all individual exchange lines up to and excluding twenty-five (25) lines.
(b)
Definitions. The definition of terms set out in the Act, are adopted as the definition of terms in this section.
(c)
Collection; remittance; administrative fee generally. The fees imposed under this section shall be collected by the telephone companies providing "911" services and equipment to Franklin County and remitted to the Franklin County Board of County Commissioners, less an administrative fee equal to one percent of the fees collected, which administrative fee shall be retained by the telephone companies as provided in the Act.
(d)
Due date for remittance. The remittance to the Franklin County Board of County Commissioners, provided for in paragraph (c) above, shall be within thirty (30) days following the regular billing cycle utilized by the telephone companies in billing its subscribers for telephone service.
(e)
Effective date of fees; duration. The fees imposed hereunder shall be effective upon notification by the board to the telephone companies and shall be imposed for at least an eighteen-month period.
(f)
Use of fees collected. The fees collected hereunder shall be used by the Franklin County Board of County Commissioners to provide "E-911" service and equipment for Franklin County, as provided for in the Act, incurred charges, or for charges which may be incurred by the Franklin County Board of County Commissioners for its initial provision or subsequent addition of "E-911" service or equipment, or both service and equipment.
(g)
To be included in regular billing. The telephone companies providing "E-911" service to Franklin County shall include up to fifty cents ($0.50) per line per subscriber up to twenty-five (25) lines per subscriber, per month, in the telephone company's regular billing for telephone service.
(h)
Repeal. Any repeal of the authority granted to counties under the Act to impose the fees set forth herein shall be the repeal of the section.
(i)
Accounting of funds. The clerk of the circuit court, the ex officio clerk and auditor of the board of county commissioners, shall establish appropriate accounting of funds to administer the funds collected pursuant to this section; which said funds shall be utilized pursuant to the provisions of the Act.
